By accessing, browsing, or making a reservation through our Website, you ("User", "Customer", "Traveler") acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and ElysiaGo regarding your use of our services.
2. Scope of Services
ElysiaGo provides an online booking platform that allows you to discover and book guided tours, cultural activities, and localized experiences (the "Services"). We act as the principal organizer of the tours unless stated otherwise. When tours are operated by certified third-party guides ("Partners"), ElysiaGo ensures the vetting and quality control but acts as an intermediary facilitating the transaction and coordination.
3. Booking and Registration
To make a reservation, you must be at least 18 years of age and possess the legal authority to enter into this agreement. You agree to provide accurate, current, and complete information during the booking process. Upon successful booking, a user account may be automatically created to help you manage your reservations. You are responsible for maintaining the confidentiality of any login credentials and are fully responsible for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or cancel orders in our sole discretion if fraud or unauthorized activity is suspected.
4. Pricing, Payments, and Taxes
All prices are listed in Euros (€) and include applicable local taxes (VAT) unless otherwise specified. Prices are subject to change without prior notice; however, the price displayed at the time of your confirmed booking is guaranteed. Full payment is required at the time of booking to secure your reservation. Payments are securely processed through our certified third-party payment gateways (e.g., Stripe, Bokun). ElysiaGo does not store your credit card details. Any bank fees or currency conversion fees imposed by your bank are your sole responsibility.
5. Cancellation and Refund Policy
We understand that travel plans can change. Our standard cancellation policy is as follows:
• Cancellations made 24 hours or more before the scheduled start time of the tour will receive a 100% full refund.
• Cancellations made less than 24 hours before the start time, or "no-shows," are strictly non-refundable (100% penalty).
• Modifications: Requests to change tour dates or times are subject to availability and must be made at least 24 hours in advance.
ElysiaGo reserves the right to cancel any tour due to extreme weather conditions, guide emergencies, or force majeure. In such rare events, you will be offered an alternative date or a full refund.
6. User Conduct & Responsibilities During Tours
You agree to arrive at the designated meeting point at least 15 minutes prior to the tour's start time. Guides are not obligated to wait for latecomers, and late arrivals will be treated as no-shows (non-refundable). You agree to follow the instructions of the guide, respect local customs, laws, and the rights of other participants. ElysiaGo reserves the right to remove any participant from a tour without refund if their behavior is deemed disruptive, abusive, or dangerous.
7. Intellectual Property
All content on the Website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of ElysiaGo or its content suppliers and is protected by international copyright and trademark laws. You may not extract, reproduce, or utilize any parts of the content without our express written consent.
8. Limitation of Liability
To the maximum extent permitted by law, ElysiaGo shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your access to, or use of, the Website or our Services. While we take every precaution to ensure your safety during our tours, participation is at your own risk. ElysiaGo assumes no liability for personal injury, property damage, loss of belongings, or travel delays unless caused directly by our gross negligence or willful misconduct.
9. Force Majeure
ElysiaGo shall not be held liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, strikes, natural disasters, pandemics, acts of terrorism, or government regulations.
10. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of France. Any disputes arising out of or in connection with these terms, the Website, or our Services shall be subject to the exclusive jurisdiction of the competent courts of Paris, France, without regard to its conflict of law provisions.
